TERMS OF USE

Welcome to GetHelp24! These Terms of Use ("Terms") govern your access to and use of the website gethelp24.com and all associated services, webpages, mobile or web-based features, content, community spaces, digital products, features and functionalities (collectively, the "Platform") operated by GetHelp24 Private Limited ("GetHelp24", "we", "us", or "our"). 

These Terms constitute an agreement between you and GetHelp24 and shall be governed by the Information Technology Act, 2000 ("IT Act") and applicable rules made thereunder. By accessing, browsing, registering on, or using the Platform in any manner, you ("User", "you", "your") agree to be bound by these Terms, our Privacy Policy, and any additional terms applicable to specific services or features. If you are registering an account or using the Platform on behalf of an individual or entity other than yourself, you represent that you are authorized by such individual or entity to accept these Terms on such individual or entity's behalf.

In addition, you understand that the specific method, features and services offered on the Platform may be altered, improved, removed or adapted at any time by GetHelp24 in its sole discretion and without any notice.

GetHelp24 is a technology-enabled digital platform that facilitates access to legal information, online consultations with independent lawyers and legal professionals, downloadable legal resources, community discussions, and related support services. GetHelp24 is a platform facilitator and intermediary. It is NOT a law firm, advocate, or legal service provider. It does not practise law and does not provide legal advice in its own capacity.

Lawyers, legal professionals or other persons onboarded to provide legal consultation or related support through the Platform may be referred to on the Platform as “Lawyers”, “Legal Experts” or “Helpers”. The term “Helper” is only a user-friendly Platform label and does not change the professional status, duties or independent nature of the concerned professional. All legal advice and services are rendered solely by these third-party professionals, who are not employees of GetHelp24. The Platform's role is limited to facilitating connections and supporting the resolution process through technology. GetHelp24 is no way, directly or indirectly responsible for the consultation and assistance provided by the Lawyers.

We are on a mission to make law accessible and affordable to every individual, entity, and business by working towards minimizing the trust barriers through knowledge and awareness. GetHelp24's main objective is to legally empower and cater to the needs of the individuals, entities and businesses. GetHelp24 is constantly evolving and developing various products to fulfill its purpose. 

The Platform currently offers the following services and features, which may be updated, modified, or expanded from time to time:
(a)  Online legal consultation booking with Lawyers onboarded on the Platform;
(b)  Free question/query submission and responses;
(c)  Downloadable digital products such as legal guides, templates, manuals, checklists, and PDFs;
(d)  A community forum ("GH24 Community") for discussion on legal topics;
(e)  Blogs, legal updates, articles, and newsletters;
(f)  Lawyer/Helper onboarding and registration;
(g)  Subscription and membership plans for Users and Helpers.

GetHelp24 reserves complete and sole discretion with respect to the operation of our services. We may, among other things withdraw, suspend or discontinue any functionality or feature of our services.

All Users must be eighteen (18) years or older. In the case of minor (under eighteen years), a parent or guardian must accept this Agreement and guide all consultations under the services offered.

The User takes full responsibility for ensuring that the information submitted is accurate. The Platform shall make no effort to validate any information provided by the User for use in Services with respect to content, correctness or usability. We with an intention to provide the best service possible could ask you to share more information as and when needed.

Some services and features on the Platform may require you to create an account or log in. You agree to provide accurate, current, and complete information during registration and to keep your account details up to date. 

We may refuse, suspend or terminate an account if information appears inaccurate, misleading, incomplete, unlawful or in breach of these Terms.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify GetHelp24 immediately at support@gethelp24.com if you suspect any unauthorised access or use of your account.

GetHelp24 is not liable for any loss or damage arising from unauthorised access to your account resulting from your failure to keep credentials secure. The User account may be canceled/suspended/terminated at the discretion of GetHelp24 in case the User is in breach of the Terms.

Your GetHelp24 User Account is created to store record of your consultations and your personal query / problem information online, including history, etc. Any information provided as part of a web, over-phone or video consultation becomes part of your profile record. You agree to provide accurate information to help us serve you best to our knowledge, to periodically review such information and to update such information as and when necessary.

GetHelp24 reserves the right to maintain, delete or destroy all communications and materials posted or uploaded to the Platform according to its internal record retention and/or destruction policies. You might be contacted via email to review the information provided by you for profile record or for online consultations. Please make sure you provide a valid email-id and you update it as and when needed.

You may be able to submit questions, facts, messages, comments, reviews, documents, case details, files, images, feedback or other materials through the Platform (“User Submissions”). You are responsible for ensuring that User Submissions are accurate, complete, lawful, relevant and shared with proper authority. Do not submit any information or documents that you are not authorised to share. Your submissions must not violate any applicable law, privacy rights, confidentiality obligations, or third-party rights.

You should share only the information necessary for your request. You should avoid posting confidential, sensitive, personal, financial, medical, identity, case-specific or third-party information in public areas of the Platform. 

By submitting content and sharing your feedback, comments, or testimonials on the Platform, you grant GetHelp24 a limited right to host, store, process, display, transmit and use such content to operate, provide, improve, protect and moderate the Platform, subject to our Privacy Policy and applicable law. This may include featuring your words across our marketing, promotions, educational materials, internal improvements, and other related platforms. By doing so, you acknowledge and agree that no further permission or compensation will be required for this fair use of your insights.

Accessing the Platform, reading content, submitting a free query, downloading resources, or participating in the community forum does NOT create a lawyer-client relationship between you and GetHelp24. A lawyer-client relationship, if any, arises solely between you and the concerned Lawyer/Helper, subject to the terms of your engagement with that Helper.

GetHelp24 is not a party to any lawyer-client relationship and does not assume any professional duties, obligations, or liability arising from such a relationship.

Content on the Platform, including blogs, articles, FAQs, newsletters, public answers, community discussions, templates, checklists, guides, manuals, downloadable digital products and other general resources, is provided for general information and awareness only. Such content may not be complete, updated, applicable to your specific facts or suitable for your intended use and should not be relied upon as a substitute for advice from a qualified legal professional on your specific facts and circumstances. Articles, blogs, newsletters, and legal updates published on the Platform may not always reflect the most current legal developments or the law applicable to your specific situation. 

GetHelp24 does not guarantee any legal outcome, result, success, relief, settlement, court order, regulatory decision or specific response in any legal matter. We do not guarantee that a web-based consultation, over-phone consultation or in-person / video consultation is the appropriate way to resolve/ solution for your particular problem.

All digital products made available are licensed for your personal or internal use only. You must not copy, reproduce, resell, redistribute, publish, or commercially exploit any digital product without the prior written permission of GetHelp24.

For urgent legal matters, matters with limitation periods, court proceedings, police matters, regulatory filings, or emergency situations, you should seek immediate assistance from a qualified advocate or legal professional without delay.

Consultations and professional advice made available through the Platform are provided by independent Lawyers, Legal Professionals or Helpers. GetHelp24 may facilitate discovery, booking, communication, payment, access or support, but does not control the professional judgment, advice, conduct, responsiveness, availability or outcome provided by any Lawyer/Helper.

The Lawyer/Helper is responsible for the advice or service provided by them. Users are encouraged to exercise their own judgment when engaging a Helper and to seek clarification or a second opinion where appropriate.

For urgent, limitation-sensitive, court-related, police, regulatory, filing-deadline or emergency matters, you should directly contact a qualified lawyer without delay and should not wait for a Platform response.

GetHelp24 verifies lawyers and legal professionals before onboarding them on the Platform, based on documents and information submitted by them and such other checks as GetHelp24 considers appropriate. 

Verification is intended to improve trust and platform quality. However, it does not amount to a guarantee of any specific legal outcome, quality of advice, professional conduct, availability, experience, continued eligibility or fitness for any particular matter.

The Platform may include a forum or community space for general legal discussion and knowledge sharing. Public posts, comments, replies, usernames or profile details may be visible to other Users and the public.

 

The GH24 Community or any other forum is not a private consultation space. You must NOT:
(a)  Disclose sensitive personal details, confidential facts, case papers, or private information publicly;
(b)  Post content that is abusive, defamatory, false, hateful, harassing, threatening, unlawful, infringing, harmful, discriminatory, obscene, or misleading;
(c)  Spam, advertise, or promote third-party services or products without authorisation;
(d)  Impersonate any person or entity, including lawyers or GetHelp24 representatives;
(e)  Post content that infringes any intellectual property or privacy rights.

GetHelp24 may moderate, edit, hide, remove, restrict or disable content or accounts where we believe there is a breach of these Terms, risk to Users, legal concern, professional concern or misuse of the Platform or otherwise in its sole discretion.

GetHelp24 may offer subscription or membership plans for Users and Lawyers/Helpers. Different plans may include different features, benefits, access rights, usage limits, visibility, support levels, pricing, validity periods, renewal terms, cancellation terms and other conditions.

Specific plan details, pricing, and applicable terms will be set out on the relevant plan page, checkout page, or separate subscription terms available on the Platform.

GetHelp24 may modify, suspend, upgrade, downgrade or discontinue plans or plan features in accordance with applicable terms and law. Continued use of a plan after changes are notified or displayed may be treated as acceptance of the updated plan terms.

1. GetHelp24 has full rights to publish the free advice provided to their Users on the Platform and in any external communication for public knowledge sharing. However, in none of the published content the User details will be displayed. We strongly advice you NOT TO mention any person / party / company's name as part of your Free Question, as you may be liable for defamation if the person / party / company takes objection to the same.

2. If you choose to submit a Free Question on the Platform, you will not be charged any fees Also, any answers you receive from Lawyers to Free Questions will not involve any Lawyer-client relationship and will be publicly displayed and viewable by all Users. You cannot choose the Lawyer that’ll answer the Free Question submitted by you – this is decided by the system automatically. The Lawyer may choose NOT to answer your question with or without assigning a reason for the same. You will be intimated in such cases via email, SMS and / or phone. Our Lawyers might be unavailable at times owing to existing questions lined up with them, and we will not be accepting free questions during such times.

3. GetHelp24 has multiple Lawyers for the same practice area and there might be instances wherein a similar question has been answered in two different ways by the Lawyer(s). GetHelp24 takes no liability towards these different opinions and answers of the Lawyers and encourages you to take another opinion from ‘your’ Lawyer / alternately decide which opinion to go ahead with based on merits and logical conclusions.

4. As a part of the Platform services , you will also be eligible to avail the benefit of online video consultation with one of the Lawyers. Please note that the benefit of a video consult is merely a consulting model and any interactions and associated issues with the selected Lawyer, including but not limited to your legal issues and/or your experiences is strictly between you and the selected Lawyer. You shall not hold us responsible for any such interactions and associated issues. Any video consultation that you have had with the selected Lawyer is completely confidential.

Certain services, consultations, subscriptions, digital products or features may be paid. You agree to pay all applicable fees, charges and taxes displayed or communicated at the time of purchase, booking or subscription.

Payments may be processed through third-party payment gateways, banks, UPI providers, card networks or other payment service providers. GetHelp24 does not store your payment card information. Your use of those payment services may be subject to their own terms and policies.

Refunds, cancellations, rescheduling, no-shows, failed payments and subscription cancellation terms, where applicable, may be provided separately on the Platform, at checkout, in the applicable plan terms, in a separate Refund/Cancellation Policy as communicated on the Platform, or upon request at support@gethelp24.com. Unless specifically stated, purchase of digital products may be non-refundable once access or download is provided. 

GetHelp24 after your consent may send you newsletters and other information regarding common related topics or preventive care messages containing specific services’ related information, links to other related websites and specific questions related to your profile record. 

These communications and resources are not comprehensive and do not include complete potential information pertaining to the subject matter. These are solely meant for general, educational and informational purposes and should not be relied upon as a substitute for user-specific query / problem evaluation or construed, directly or indirectly as the practice of that particular service or dispensing of that particular service by the Platform.

The information contained in these communications and resources is compiled from a variety of sources and may or may not be authored by GetHelp24. GetHelp24 makes no warranty with respect to the content of these materials or the information contained therein.

If you have subscribed to marketing communications, newsletters or updates, you may unsubscribe at any time using the unsubscribe option in the communication or by contacting us at support@gethelp24.com. Service-related communications may still be sent where necessary for account, booking, payment, security or legal reasons.

Promotional Campaigns

a) GetHelp24 may, from time to time, run promotional campaigns offering discounts, incentives, or other benefits to Users. Each promotional campaign shall have its own specific terms and conditions, which will be applicable only for the duration of the respective campaign.

b) The terms and conditions of any such promotional campaign shall be in addition to and read together with the present Terms. In case of any conflict between the promotional campaign terms and these Terms, the specific terms of the campaign shall prevail for the duration of the campaign only and only to the extent of such conflict or inconsistency.

c) GetHelp24 reserves the right to modify, withdraw, or terminate any promotional campaign at its sole discretion without prior notice, subject to applicable laws.

d) Participation in any promotional campaign does not entitle the User to any permanent benefit or future discounts, unless explicitly mentioned in the campaign terms.

You agree not to misuse the Platform or use it for any unlawful, fraudulent, harmful or unauthorised purpose.

You must not scrape, crawl, copy, harvest, reverse engineer, interfere with, overload, hack, test vulnerabilities of, bypass security of, or disrupt the Platform or its systems.

You must not impersonate any person, misrepresent your identity or authority, post spam or unauthorised advertisements, upload malware, infringe intellectual property rights, misuse consultations, misuse subscription benefits, manipulate reviews or ratings, or attempt to obtain unauthorised access to accounts, data or systems.

In accordance with these Terms, both GetHelp24 and the User acknowledge that they may receive confidential information from each other, including but not limited to business models, trade secrets, data, products, services, technologies, concepts, and personal data. Both parties agree to maintain the confidentiality of such information, using it solely for the purposes specified in these Terms, and refraining from disclosing it to third parties without prior written consent, except to individuals who need to know the information to fulfill their duties and are legally or contractually obligated to maintain its confidentiality. This obligation to maintain confidentiality commences upon the effective date of the Terms and continues indefinitely, surviving the termination of your agreement with us. GetHelp24 maintains the confidentiality of any personal data they come into contact with or during the course of their work. This includes not disclosing data to unauthorized individuals.

GetHelp24 shall retain all rights, titles and interests in the software and its Confidential Information and all its intellectual property rights thereto supplied to you under these Terms. All content, materials, design, text, graphics, logos, templates, guides, and other elements available on the Platform ("Platform Content") are the intellectual property of GetHelp24 or its licensors, unless otherwise stated.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform Content for lawful personal or internal purposes only, in accordance with these Terms.

Nothing in these Terms transfers any ownership of intellectual property to you. You must not copy, reproduce, modify, publish, distribute, sell, sublicense, commercially exploit or create derivative works from any Platform Content without prior written permission from GetHelp24.

The Platform may include links to, or integrations with, third-party websites, tools, payment gateways, video conferencing services, booking tools, or other external services. These are provided for convenience only.

GetHelp24 does not endorse, control, or take responsibility for the content, policies, privacy practices, or services of any third-party website or platform. Your use of third-party services is governed by their respective terms and policies.

GetHelp24 shall not be liable for any loss or damage arising from your use of or reliance on any third-party service or content accessed through the Platform.

The Platform and all services, content, and features are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied to the maximum extent permitted by law.

GetHelp24 does not warrant or guarantee:

(a)  That the Platform will be available without interruption, error, or delay;

(b)  That all content is accurate, complete, or current at all times;

(c)  That any legal outcome, resolution, or result will be achieved through use of the Platform;

(d)  The availability, response time, or quality of any particular Helper;

(e)  That the Platform will be free from viruses, bugs, or other harmful components.

Nothing on the Platform should be treated as a promise that any legal issue will be resolved, that any document will be accepted by any authority, court or third party, or that any specific result will be achieved.

GetHelp24 does not provide any warranties beyond what is explicitly agreed upon in these Terms or within the scope of work agreed upon with you. GetHelp24 does not warrant or guarantee a specific outcome of your query due to the discretionary power of authorities, tribunals, courts. We will perform the services in accordance with the applicable legal standards and ethical rules governing the legal profession. GetHelp24 specifically disclaims all liability for any actions resulting from your use of the services, API and software. You acknowledge that you may use and access the services and software at your own discretion and risk. You warrant that you shall provide accurate information to GetHelp24 in order for the Platform to provide the best possible legal resolution to you.

We connects Users with a network of Lawyers across India to provide legal advice. These Lawyers and their representatives are not employees of GetHelp24, and we do not receive any commission or financial benefit whatsoever from the associated Lawyer. GetHelp24 disclaims any fiduciary relationship or other special relationship with Lawyers associated with it and specifically disclaims any liability arising out of the acts or omissions of a Lawyer, whether directly or incidentally. By using the services, you acknowledge and agree that GetHelp24 is not responsible for the conduct, performance, or quality of the legal advice provided by the associated Lawyers. GetHelp24 shall not be liable for any loss or damage arising from your reliance on such legal advice or from any interaction or agreement between you and the Lawyers.

The User acknowledges that to the maximum extent permitted under applicable law, GetHelp24 and its directors, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, business, or goodwill, arising out of or in connection with:

(a)  Your use of or inability to use the Platform;

(b)  Reliance on any content, information, or resources available on the Platform;

(c)  Advice, conduct, or services provided by any Helper;

(d)  Any technical failure, interruption, or security breach affecting the Platform.

GetHelp24's total aggregate liability to you, if any, shall not exceed the amount you have actually paid to GetHelp24 for the specific service giving rise to the claim in the two months preceding the claim. 

Nothing in these Terms limits liability for death, personal injury, or fraud caused by GetHelp24's gross negligence or wilful misconduct.

The User agrees to indemnify and hold GetHelp24 harmless from any claims, damages, liabilities, and expenses arising from the User's misuse of the services or violation of these Terms. We do not guarantee a specific legal resolution or outcome. We provide access to legal services and assistance, and have no influence over legal proceedings. 

GetHelp24 reserves the right to provide its Users access to the legal solution /information in a manner which it deems appropriate by means of the technology being in compliance with the laws.

Termination by GetHelp24: GetHelp24 reserves the right to suspend, restrict, or terminate your account and access to the Platform and our services, with or without prior notice or liability, for any reason, including (without limitation) if:
(a)  You violate any provision of these Terms;
(b)  You misuse or abuse any Platform feature, service, or community space;
(c)  You fail to pay applicable fees for paid services or subscriptions;
(d)  Your use of the Platform creates risk or liability for GetHelp24 or other users;
(e)  Required by law, regulation, or court order.

Termination by User: Users may terminate their account and discontinue the use of Platform's services at any time by: a) Deleting their account via the website or mobile application, where applicable, b) Submitting a written request to GetHelp24's support team for account deactivation, c) Ceasing to use Platform's services, subject to any ongoing obligations under these Terms. 

Upon termination, your right to use the Platform and services ceases immediately. Provisions of these Terms that by their nature should survive termination shall continue in effect.

GetHelp24 reserves the right to modify, amend, change, or update the Terms at its sole discretion. The revised Terms will be posted on the Platform with an updated effective date. Continued use of the Platform following any amendments or changes to the Terms constitutes your explicit acceptance of the revised Terms, and you agree to be bound by these updated Terms. We encourage you to review these Terms periodically to stay informed of any changes.

If you are Lawyer, participating in any aspect of this Platform, you acknowledge that rules of professional conduct apply to all aspects of your participation and that you will abide by such rules. The rules include, but are not limited to, the rules relating to advertising, solicitation of clients, unauthorised practice of your respective profession, and misrepresentations of fact. We disclaim all responsibility for your compliance with these rules.

These Terms shall be governed by the laws, regulations, and rules applicable in the territory of India without reference to the applicable laws of conflict. The Courts at New Delhi, India shall have exclusive jurisdiction relating to any matter/issue under or pursuant to the Terms.
